Attorney General's Office
The Attorney General's Office is located at 354 Industrial Road in the Pearl River Community. The office prosecutes all criminal cases on the reservation; is the primary liaison between the Tribe and the State of Mississippi; serves as in-house counsel to all Tribal agencies and enterprises; handles land acquisition for the Tribe; pursues large-scale consumer protection matters; advises the Tribe in contractual matters; and provides in-service training to all Tribal entities.
Law Enforcement Services
The Choctaw Law Enforcement Services Programs, the Choctaw Police Department, Choctaw Detention Facility, and the Wildlife and Parks Program. These programs enforce Tribal, State, and Federal law on reservation lands. Although Federal Agencies are responsible for felony violations on the reservation, the Choctaw Police Deparment conducts full investigations of felony cases, some are assisted by the FBI. All felony cases are then turned over to the United States Attorney's office for review. Tribal violations are handled through Tribal Court. The Choctaw Detention Facility is responsible for the safe housing and care of inmates who are arrested or sentenced to serve time. The Choctaw Wildlife and Parks Program handles the hunting and fishing regulations. They are also responsible for the parks and wildlife control.
Choctaw Legal Defense
While the MBCI Attorney General's office represents the Tribal Government and its various agencies and enterprises, Legal Defense is the people's law firm. Legal Defense represent individual Tribal members in Choctaw Tribal Court, Federal Courts and the Municipal, Justice, Chancery and Circuit Courts of Mississippi. In addition, Legal Defense responds to numerous requests for counsel and advice by Tribal members. Priority cases are felony criminal cases, consumer matters and those affecting Tribal jurisdiction and enrollment. Criminal cases handled include felonies (manslaughter, murder, rape, DUIs, burglary, possession/sale of drugs, etc.) and misdemeanors (assault, trespassing, shoplifting, etc.). Civil cases handled include matters concerning consumer law (collections, repossessions, etc.), family law (divorce, adoption, custody, child support, etc.), Indian law (blood quantum, enrollment, jurisdiction, Indian Child Welfare Act, etc.), youth law, wills and estates and other types of noncriminal cases.
Choctaw Tribal Court
The Tribal Court has four separate courts with a designated judge over each court and associate judges to assist. Any matter involving offenses by non-members of the Mississippi Band of Choctaw Indians may be handled under the jurisdiction of the U.S. Magistrate. Certain felony offenses may be handled under the jurisdiction of the Federal courts.
Juvenile Probation Office
Juvenile probation is the oldest and most widely used vehicle through which a range of court-ordered services is rendered. Official duties include intake screening of cases referred to the Tribal Youth Court (deciding if it is necessary to go to formal proceedings or if another alternative is more appropriate), predispostion or pre-sentence investigation (uncovering the source of the conflict and why the child is behaving irresponsibly) and court-ordered supervision of juvenile offenders (assuring those on court-ordered probation complete the ordered terms).
Adult Probation Office
The office conducts studies and prepares reports of each offender placed before the Choctaw Tribal Court and makes recommendations to the Criminal Court at the pre-trial levels for possible referral to the Peacemaker Court. Personnel also works closely with the Choctaw Police Department to supervise adult defenders for the protection of the community.
